Fixture Lapse Dates The lapse date of a record that perfects a security interest in fixtures should be easy for the secured party to determine. The lapse date, if any, is determined by the type of record involved. Under Section 9‐515(a), a filed financing statement is effective for five years after the date of filing.
Fixtures, is defined by UCC Section 9‐102(a)(41) as goods that have become so related to particular real property that an interest in them arises under real property law. Under this definition, fixtures have characteristics of both personal property and real property.
A fixture filing is the filing of a financing statement that covers goods that are or will become fixtures. This submission is legally authorized and executed in adherence to the UCC adopted in the state where the related real property is located.
Tax lien. Remember, tax liens always take the highest priority among other liens. If a mortgage lien exists on a property and a tax lien is created, the tax lien will take first priority even though it was created after the mortgage lien.
How long does a UCC filing last? A UCC-1 filing is good for five years. After five years, it is considered lapsed and no longer valid.
A fixture filing is also effective for the general five-year duration and effectiveness rule under Article 9. There are no special duration and effectiveness rules for fixture filings. It has to be continued every five years.
