The terms agreement and contract are often used interchangeably, but they arent necessarily the same thing. A contract is a specific agreement usually in writing and signed with terms and conditions that are enforceable in court. An agreement may fall short of being an enforceable contract.
Once all parties sign a letter of agreement, it becomes a binding legal document. You should include a signature block at the end with room for both signatures and dates with the heading Acknowledged and Agreed. Both parties should keep a final, signed copy for their records.
Here are the steps to write a letter of agreement: Title the document. Add the title at the top of the document. List your personal information. Include the date. Add the recipients personal information. Address the recipient. Write an introduction paragraph. Write your body. Conclude the letter.
Any agreement that two parties make can be legally enforced, whether its written or verbal. A signed document is important to have since it provides proof that an agreement exists and shows both parties agreed to identical terms.
An email contract can be an enforceable agreement even if it is not printed out on paper. If you think that you do not have a legal leg to stand on because your contract was done via email, think again. In almost all circumstances, your agreement will be considered enforceable even if it was done through email.
Non-binding contracts are typically used when two parties want to put down preliminary discussions on paper to make sure theyre on the same page, but dont want to explicitly agree to anything yet. A Letter of Intent is a good example of a non-binding contract.
