It was 1971 when Ray Tomlinson invented and developed electronic mail, as we know it today, by creating ARPANETs networked email system. The concept of nearly instantaneous communication between machines within an organization proved to be so beneficial and practical that the concept soon began to spread.
A poor mans patent is essentially writing out a description of your invention and then mailing that written description to yourself. This postmarked envelope supposedly acts to create the date of your invention as the date this written description was postmarked.
Question: No, an email is not intellectual property. An email could possibly be subject to intellectual property protection (most likely copyright, assuming there was sufficient authorship), but it is not IP.
Even under the old system, i.e., the first to invent system, a poor mans patent standing alone, i.e, without a patent application, was worthless. You cannot access the court system and ask a judge or a jury to enforce a right that the U.S. Government does not even recognize as a right.
There are four different patent types: Utility patent. This is what most people think of when they think about a patent. Provisional patent. Design patent. Plant patent.
The cheapest way to get Patent Pending status is to file a provisional patent application. All that is required is a detailed description of the invention, an informal drawing, and a synopsis of how you came up with the idea. For small entities, the application fee is $130 and for large companies it is $260.
While, under the first to invent patent system, there may have been some merit to the notion of documenting the date of conception of an invention in this way, the poor mans patent is not a formally recognized procedure and does not actually confer any rights to the inventor.
Updated October 28, 2020: People have used a poor mans trademark for years. Also called a poor mans copyright, this entails a person mailing their own art and writing to themselves through the U.S. Postal Service. These pieces of mail are not opened once received.
