What is a Business Associate? Simply put, a Business Associate is a person or entity that performs certain functions or activities that involve the use or disclosure of protected health information for a Covered Entity. By law, the HIPAA Privacy Rule applies only to Covered Entities.
What is a business associate agreement? A business associate agreement establishes a legally-binding relationship between HIPAA-covered entities and business associates to ensure complete protection of PHI. The HIPAA Rules generally require that covered entities and business associates enter into contracts with their business associates to ensure that the business associates will appropriately safeguard protected health information.
