When both parents (or guardians) agree on how they want to change the child custody order, they can file a joint stipulation with the court. Since both parties agree on the changes, the judge will usually sign off on it.
To change (modify) a Parenting Plan and Parental Responsibility, a parent must list how the childs circumstances have substantially changed and/or how changes in a parents circumstance have substantially impacted the child, and describe how making a change will be good for the child.
A child support modification becomes official only via a court order. This means for any of the terms to be modified, even if both parents are in agreement, a judge must approve an agreement or change the original order.
To compensate for changes, Florida law allows parties to petition for the modification of custody. However, for a court to grant a modification of the time-sharing arrangement, the petitioning parent must provide evidence of a substantial, material, and unforseeable change in circumstances.
You can change an existing court order or consent order. You can also ask a court to enforce an order if your ex-partner is not following it. If you ask the court to change or enforce an order, youll probably have to go to a court hearing.
If child custody is part of a court order, the parent seeking modification needs to file a motion to modify the custody order with the court. The parents can, of course, agree on a modification and submit it to the judge for approval. This is commonly referred to as a consent order and is often the best approach.

Common substantial changes in circumstances may include: a loss or gain of employment, a sudden change in either partys finances, a relocation of the parties or children, a death, a change in the childs wishes, etc.
While some states allow children of a certain age to choose one parent over the other, there is no such law in North Carolina that would allow children to choose which parent to live with at a certain age. In other words, it does not matter whether your child is 5 or 15.
You will be required to pay a $50 filing fee to essentially re-open your divorce case, and your request for modification will have the same case number as your original child support order.
