A photography contract is a legally binding agreement between a photographer and their client(s). It defines the rights and obligations of the parties, to include payments, deliverables, schedules, etc. A good contract will also cover copyright, usage rights, limits of liability and more.
Like any other contract, a photography contract outlines what is expected from both parties. On the part of the photographer, it will specify what they are required to do; when they are to take photographs (the date or dates), when they will deliver the photographs, and how much they want to be paid for their services.
A photography contract is legally binding, even if you write it yourself. As long as you and your client sign a contract that meets the basic requirements outlined by contract law, it is considered a legally binding contract. Its important to remember that a contract must be in writing and signed by both parties.
Your photographer contract should identify the fees agreed between the two parties and what those fees cover. It should state whether any deposit is required and how much that is. It should also clearly state when full payment or balance is expected by and whether there are any conditions attached to that payment.
Be sure to include the following on your next freelance photography contract: Name. This should include your clients legal name or the business name responsible for the session. Address. Location. Delivery. Cancellation policy. Payment method. Transfer of use rights and copyright ownership. Liability.
