What happens to the holding deposit when the tenant moves in? Once the tenant is ready to move in, you can simply refund the holding deposit or agree to deduct it from the first months rent. If the holding deposit is being refunded, it must be done within seven calendar days of the tenancy start date.
You can contact your local county court and start proceedings against your landlord. If it is found that your landlord has not protected your deposit they will be ordered to either repay it to you, or to pay it into a custodial scheme within 14 days.
Ask your landlord for permission The tenant you are swapping with must also get permission from their landlord. Put your requests for a swap in writing. Your landlord has 6 weeks to respond in writing. You could be evicted if you try to exchange your tenancy without permission.
Most states dont impose a limit on how much a landlord can charge for damages, but you should be able to justify the expense of making repairs. Landlords cant charge for normal wear and tear, such as thin spots in carpeting near the front door that appear after five years.
If theres a change of landlord or agent dealing with your deposit: the old landlord or agent should inform the protection scheme they use. the new landlord or agent should arrange for the deposit to remain protected.
Can I change my deposit for an existing tenant? No. The deposit is protected at the start of the tenancy and must be returned to the tenant when they leave the property (less any lawful deductions).
A tenancy agreement can normally only be changed if both you and your landlord agree. If you both agree, the change should be recorded in writing, either by drawing up a new written document setting out the terms of the tenancy or by amending the existing written tenancy agreement.
