whats up fellow entrepreneurs today I want to talk about tolling agreements its not a big subject its not something that I get asked about a lot but its just come up a few times in the last week and so I thought I would mention it because each time I had to explain to my client why they should do it or shouldnt do it and it is subjective and based on strategy so first let me tell you what a tolling agreement is typically when a plaintiff site attorney sends you a demand letter instead of suing you what theyll do is theyll out of tolling agreement and theyll say something like heres everything we think you did wrong heres all the records that we want and heres a tolling agreement attached sign the tolling Agreement and send it back to us or were going to file a lawsuit automatically some attorneys do some attorneys dont but what a tolling agreement is is that it tolls the statute of limitations so every labor claim well every claim typically except some things in criminal l

A tolling agreement is a formal written agreement to suspend the statute of limitations for a period of time.
The legal definition of toll means that there can be a pause or a delay in the time period set forth by a cases statute of limitations. The statute of limitations is the legal policy that puts in place a time period in which a case can be brought to court after certain actions.
A tolling agreement is a written agreement, signed by both sides to a potential lawsuit, that suspends the statute of limitations for an agreed amount of time.
