Amendment Amendment after Notice of Allowance (Rule 312) When applicant files an amendment after the Notice of Allowance has been mailed but before the issue fee is paid, the amendment is not entered automatically. It may only be entered upon recommendation of a Primary Examiner.
Amendments to Claims You can change the claims of a patent without filing a new application unless you are making a new claim. If you are making a new claim, you will need to file a new patent application. Federal regulations governing the USPTO provide specific rules for amending patent claims.
Unfortunately, under United States patent law you can not amend the patent to include the new subject matter reflecting the improvement you made to the invention. You will have to file a new patent application for the improvement to the invention instead of filing an amendment to the patent.
AMENDMENTS FILED AFTER PAYMENT OF ISSUE FEE. No amendments should be filed after the date the issue fee has been paid.
Drawing changes must be made by presenting replacement sheets which incorporate the desired changes and which comply with 37 CFR 1.84. An explanation of the changes made must be presented either in the drawing amendments section, or remarks, section of the amendment paper.
1.312 Amendments after allowance. Any amendment filed pursuant to this section must be filed before or with the payment of the issue fee, and may be entered on the recommendation of the primary examiner, approved by the Director, without withdrawing the application from issue.
The specification, other than the claims, may also be amended by submitting: (i) An instruction to replace the specification; and. (ii) A substitute specification in compliance with 1.125(b) and (c).
In the context of Patent, an amendment after payment of issue fee is an amendment made by the applicant after the application has been allowed and the issue fee paid. This is a statutory amendment. Such an amendment is not made as a matter of right but is controlled by 37 CFR 1.312.
