BAAs are mandated by the HIPAA Security Rule. Business Associate Agreements consist of information regarding the permissible and impermissible uses of PHI between two HIPAA-beholden organizations.
A business associate subcontractor agreement (referred to as a subcontractor BAA) is a legally binding contract between (1) a business associate of a covered entity; and (2) a business associate of that business associate.
A written contract between a covered entity and a business associate must: (1) establish the permitted and required uses and disclosures of protected health information by the business associate; (2) provide that the business associate will not use or further disclose the information other than as permitted or required
The HIPAA Privacy Rule requires all Covered Entities to have a signed Business Associate Agreement (BAA) with any Business Associate (BA) they hire that may come in contact with PHI.
HIPAA requires that you get a BAA from every business that could have access to your clients PHI. For example, you might employ an accountant who has access to your clients names, account numbers, services rendered, etc. HIPAA requires them to sign a BAA agreeing to protect all of that PHI.
