Periodic agreement Either the landlord or tenant may end a periodic tenancy by giving notice. Most periodic tenancies are month-to-month, but they can also be week-to-week or year-to-year.
Ontario Lease Ending Notices The first option is to notify the landlord of their intention to end their tenancy. Here, your tenant must inform you of the last day they plan on living in the unit. If the tenancy is fixed-term, then your tenant must give you notice of at least 60 days before moving out.
Monthly, no fixed term: If you pay rent monthly and you are not in a fixed term tenancy, then you must give at least 60 days notice and the termination date has to be the last day of a rental month. Example: You have a month-to-month tenancy and pay rent on the first day of each month.
A periodic tenancy agreement often referred to as a month-to-month tenancy agreement does not have a pre-determined date on which it ends. The tenancy continues until the tenant gives proper notice to move out, or until the landlord legally ends the tenancy.
Under California state law, a landlord can terminate a month-to-month tenancy by serving a 30-day written notice if the tenancy has lasted less than one year, or a 60-day notice if the tenancy has lasted more than one year.
If the landlord and tenant dont make a new agreement, and the tenant refuses to leave, the landlord can apply to the LTB for an order to evict the tenant. Important: In this situation, the landlord can apply to the LTB for an eviction order without giving the tenant notice.
What are your options for getting out of a lease? terminate the lease under a break clause; negotiate termination with the landlord; assign the lease - ie sell it to a new tenant; sublet the premises, or part of the premises.
In Ontario, landlords can only increase rent once in a 12-month period and only 12 months after the date of the last legal rent increase or the tenant moving in. Landlords must also give tenants a minimum of 90 days notice that an increase is imminent.
