Mortgage: This is the document that gives the lender a security interest in the property until the Note is paid in full. If the debt is not paid, then the lender can enforce its security interest by foreclosing on the property. Anyone who is on the Deed of the property being used as collateral must be on the Mortgage.
Whats the Difference Between a Deed and a Title? A deed is a document that states you own a property, when a title is the concept of legal ownership that the deed grants. To own a home, you need both.
If your name is on the deed but not on the mortgage, your position is actually advantageous. The names on the deed of a house, not the mortgage, indicate ownership. Its the deed that passes real estate ownership from one entity to another.
If your name is on a deed to a house, then that means that you are the property owner. Having your name on a deed means that you have property title, which represents a set of rights you have as a homeowner.
The mortgage on the other hand is a just an agreement to pay back the full amount of the loan that was taken out to pay for the property. If you sign the mortgage, this means youre obligated to pay the loan amount back, but it does not give you legal ownership of the property.
Primary tabs. Reconveyance means the return of title to the original owner. Most commonly arises in the context of reconveyance of real estate deedsalso referred to as deed of reconveyance.
A deed of reconveyance refers to a document that transfers the title of a property to the borrower from the bank or mortgage holder once a mortgage is paid off. It is used to clear the deed of trust from the title to the property.
In a mortgage by demise, the mortgagee (the lender) becomes the owner of the mortgaged property until the loan is repaid or other mortgage obligation fulfilled in full, a process known as redemption.
A deed of release, also known as a deed of reconveyance, is a legal document used to renounce ones claims against a specific property. A release deed completely releases the parties from their previous obligations. While there is no discernible difference between the two, the context in which the terms are used vary.
A deed of reconveyance indicates that youve fully paid off your mortgage on your home, representing the transfer of ownership from your mortgage lender to you. Over the time you repaid your mortgage, you legally owned the property, but the lender held the mortgage lien, or claim, to it.
