In California, can a landlord change the terms of your lease without your consent? Not without written notice as long as your lease is in effect.
Changing the tenancy agreement A tenancy agreement can normally only be changed if both you and your landlord agree. If you both agree, the change should be recorded in writing, either by drawing up a new written document setting out the terms of the tenancy or by amending the existing written tenancy agreement.
A California month-to-month rental agreement allows property owners and tenants to enter into a lease under state landlord-tenant laws. Therefore, both parties must uphold the contracts terms. With this type of agreement, either the landlord or the tenant can terminate the lease at any time or for any reason.
For month-to-month tenancies, you must provide a 30-day written notice of the change in the terms of the tenancy. If the change involves a rent increase of more than 10%, a 90-day notice is required. A month-to-month lease addendum is added to a lease agreement with a fixed term to change it to a month-to-month tenancy. It outlines the new terms and changes to the original lease, such as an increase in rent and how much notice is required to end the tenancy.
The procedure for increasing rent is generally the same and depends on the amount of the increase. For an increase in rent that is 10 percent or less in any 12-month period, the landlord must provide at least 30 days advance written notice to a month-to-month resident.
