Hi! My name is Fred Glick. Today on Glick Watch we’re going to teach you how try and do real estate management yourself. We’re going to talk about our DocBox here on Glick Watch. You know, I get people who ask me questions things like “Hey! Can you write a lease for me?” Or, “How do I prorate rent?” Or, “Can you help me with showings?” Well, let’s take a step back and look at this. The rental cycle is broken up into 3 main parts where you show the property, where you actually have it rented and then when you have to turn it over when someone moves. Let’s take a look at the first one. During that phase you’ll need to have a rental application a lease agreement a move in/move out form and you’ll also need to make sure that everyone over the age of 18 who intends to live in the property applies for the property via the application. Be sure to get a valid form of ID and run a credit and background check on everyone who applies. Here’s the bottom line there are federal, state and local law...

Under the Residential Tenancies Act, a landlord is responsible for maintaining a rental unit in a good state of repair. This includes repairing worn paint. However, if the unit is in a good state of repair, the landlord has no obligation to redecorate the rental unit.
A landlord can only charge tenants for the cost of painting what goes beyond normal wear-and-tear. For example, a landlord could not charge their tenant the full cost of repainting the entire apartment if they left it in good condition after renting for just one year.
Normal Wear and Tear: Painting The owner must pay to paint over them. Painting is not billed to tenants unless there is damage to the walls.
Most states dont impose a limit on how much a landlord can charge for damages, but you should be able to justify the expense of making repairs. Landlords cant charge for normal wear and tear, such as thin spots in carpeting near the front door that appear after five years.
If you have only a verbal rental agreement with your landlord, the landlord may not charge you any fees. Your landlord may charge a fee if you abandon your home during a fixed-term lease without cause. The fee may not exceed one and one-half times the monthly rent.
Intentionally and unreasonably interfering with and substantially impairing the enjoyment or use of the premises by the tenant.
These are eight clauses that a landlord should include in a lease agreement in California: Security Deposits. Specific Payment Requirements. Late Rent Fees. Rent Increases. Notice of Entry. Rental Agreement Disclosures. Gas and Electricity Disclosure. Recreational Marijuana and Rentals.
As an Oregon landlord, you can legally deduct the following from your tenants security deposit, when relevant: unpaid rent, damage caused by a bdocHub of lease, repairs other than those to correct normal wear and tear, and any other factors you may have included in your lease.
But the landlord must have a reasonable purpose, such as to inspect the rental unit or to supply necessary or agreed upon services, and must give you a 24-hour verbal or written notice before entering, with a few exceptions.
It all boils down to what is written in your lease and its important for a landlord to put down the specifics of painting and cleaning of the property in the lease agreement. If this is not in the lease agreement a landlord cannot hold the previous tenant liable for the costs unless the property has been damaged.
