Fees to file a quitclaim deed in New York The fees to file a New York quitclaim deed vary from county to county, but some of the fees are similar. As of 2018, the basic fee for filing a quitclaim deed of residential or farm property is $125, while the fee for all other property is $250.
A quitclaim deed transfers the owners entire interest in the property to the person receiving the property but it only transfers what he actually owns, so if two people jointly own the property and one of them quitclaims his interest to his brother, he can only transfer his half of the ownership.
As indicated above, in order for the deed to be binding between the parties, the grantor must sign the deed. However, in order to be recorded in the county deed records in Texas, the grantors signature must be acknowledged. For example, you can do so through a certification by a notary public.
The fee to prepare a Property Deed for you is $195. Your deed will be prepared by a Texas licensed attorney in about an hour. This fee does not include the county recording fee. The county recording fee is approximately $15 to $40, depending on the county the property is located in.
Deeds are required to have the name of the grantor, the name and address of the grantee, the name of the preparer and an acknowledgment by a notary. Once the deed is properly drafted and signed, it must be recorded with the register of deeds in the county in which the property is located.
A general warranty deed must include the following to be valid: The name and address of the seller (called the grantor) The name and address of the buyer (called the grantee) A legal description of the property (found on the previous deed) A statement that the grantor is transferring the property to the grantee.
A property deed is usually one or two pages long, and the contents depend on what type of deed it is (more on that below), as well as the property type and location.
Fill in your name as grantor, the identity of the person or entity you are transferring it to and the real property description. Sign the deed in front of a notary, then give it to the grantee and make sure it gets filed at the appropriate government office for recording deeds.
A person can file a quitclaim deed by (1) entering the relevant information on a quitclaim deed form, (2) signing the deed with two witnesses and a notary, and (3) recording the deed at the county comptrollers office.
The New York City Real Property Transfer Tax is 1% of the price if the value is $500,000 or less, or 1.425% if it is more. Unfortunately New York State also has a transfer tax. New York State charges you an additional 0.40% transfer tax on the purchase price.
