If the beneficiary passes away before the estate is settled or before the person who made the will passes, their share of the assets will typically go to their heirs. Heirs are defined as the legal successors of a deceased person, and they are typically determined by provincial law.
An estate executor in British Columbia will need to list the value of the following assets and submit them to the probate court: Bank and investment accounts. Insurance policies. The contents of safe deposit boxes. Jewelry and decorative items. Clothing. Artwork. Furniture. Real estate and property deeds.
But if your primary beneficiary dies before you do, then the death benefit would be paid to any contingent beneficiaries that you named on your application. If there are no contingent beneficiaries, then the death benefit will most likely be paid directly into your estate.
As executor, youre required to manage all financial assets throughout the estate settlement. Assets will first be used to pay liabilities, leaving remaining assets to be distributed to beneficiaries. Once you have established your authority as executor, you can open an estate bank account, if applicable.
The Wills Estates and Succession Act (WESA) prohibits the executor or administrator of an estate (known generally as the personal representative of an estate) from making a distribution from the estate to any beneficiaries until after 210 days have expired from the date the Grant of Probate or Administration is
