Property owned jointly with rights of survivorship is treated very much like property owned with multiple beneficiaries. The general rule is that a mortgage may not stay in a deceased persons name, however exceptions may apply. Generally, if a person dies, title will transfer. If title transfers, it invokes a due-on-sale clause.
A quitclaim deed with the right of survivorship is less complex than the warranty deed. Due to its easy accessibility, a quitclaim deed helps transfer property between relatives. A quitclaim deed does not provide a warranty or information about the propertys condition before a property transfer.
If you and your spouse have a mortgage on a property thats owned jointly, as we mentioned earlier, the responsibility of making payments on the mortgage will just fall to the survivor after the first spouse passes away. In this case, the surviving spouse would become the sole owner.
When your spouse passes away, you stay the owner now the sole owner of the property. To prove this to the world and effectively remove your deceased spouse from the title, you simply have to record their death certificate in the public records.
