[15 U.S.C. 1681b] Subject to subsection (c), any consumer reporting agency may furnish a consumer report under the following circumstances and no other: (1) In response to the order of a court having jurisdiction to issue such an order, or a subpoena issued in connection with proceedings before a Federal grand jury.
A consumer report can contain a wide variety of information including credit history, past bankruptcy, judicial records, employment records, and even online activity. This information can only be accessed with approval from the individual and is highly regulated by the Fair Credit Reporting Act (FCRA).
Credit report errors can include accounts or loans that have been paid off but appear unpaid, individual loans listed multiple times, or debts that are incorrectly reported in collections. Misspelled names, wrong addresses or incorrect birth dates in a credit report can also cause problems for consumers.
Personal Credit Disputes On the personal credit side, the Fair Credit Reporting Act (FCRA) gives you the right to dispute unauthorized inquiries with any consumer reporting agency. To submit a dispute, you can contact a consumer credit bureau via mail, phone, or online.
Section 603(d) defines a consumer report to include information about a consumer such as that which bears on a consumers creditworthiness, character, and capacity among other factors. Communication of this information may cause a person, including a financial institution, to become a consumer reporting agency.
Information excluded from consumer reports further include: Arrest records more than 7 years old. Items of adverse information, except criminal convictions older than 7 years. Negative credit data, civil judgments, paid tax liens, and/or collections accounts older than 7 years.
The FTC notes that if the report contains only information obtained from the candidate, it would not be considered an Investigative Consumer Report. The information was not collected through personal interviews with third persons.
