Yes; a landlord can terminate a month-to-month lease in Ontario as long as the reason for lease termination is legal, appropriate, and processed the right way.
Often, the landlord and renter agree to the terms of the lease orally, but a month-to-month lease agreement is preferable. A written lease is a legal document, and it offers more protection to all parties to the lease. In a dispute, the written lease should help resolve the dispute.
If you have a month-to-month agreement, you can end your tenancy by giving one-month notice no later than the day before your rent is due. For example, if you pay rent on the first day of the month and want to move out by May 31st, your notice must be received by your landlord no later than April 30th.
Fixed-term: If you have a fixed-term tenancy, like a one year lease, then you must give notice at least 60 days before the end of the lease. The termination date cannot be before the last day of the fixed term. If you dont give notice, the tenancy continues.
Monthly, no fixed term: If you pay rent monthly and you are not in a fixed term tenancy, then you must give at least 60 days notice and the termination date has to be the last day of a rental month. Example: You have a month-to-month tenancy and pay rent on the first day of each month.
Rent Increases The landlord can increase the rent once every 12 months. The landlord must give the tenant a 90-day written notice of the increase before it takes effect. There are some exemptions to these rules, for example tenants paying rent-geared-to-income in a social housing unit.
In Ontario, when a residential lease expires, and there is no new lease, the tenancy automatically becomes a month-to-month tenancy. The main advantage for tenants with a month-to-month tenancy is that they have much more flexibility if they decide to move.
