A prenup is more likely to be enforceable than a postnup if one of the signers attempts to dispute it following dissolution of the union. Divorce courts tend to presume that coercion is less likely when independent people are signing before they are actually married and have mixed their assets.
A prenuptial agreement can be amended, but any modification must be agreed to by both spouses. Known as an amendment, if both spouses agree as to the changes in the prenup the alteration can be as simple as drafting the amended document and having both spouses sign it.
As long as you and your spouse agree, your prenuptial agreement can be changed. To create an amendment to a prenup, you can either add to the original contract or sign a separate contract that modifies the terms of the initial agreement. This is true for revoking also.
A prenup can also be overturned if one or both parties change their mind after initially signing the agreement. They may decide at that time to sign a new agreement suspending the prenup.
What doesnt a prenuptial agreement cover? Child custody or visitation matters. Child support. Alimony in the event of a divorce. Day-to-day household matters. Anything prohibited by the law.
California prenuptial agreements cant include terms that are considered unconscionable when it was signed.They include the following: Child custody; Child visitation; Child support; Waiving spousal support; Encouraging divorce; Unreasonable terms; Any matter that violates the law; Personal issues.
A prenuptial agreement in California can always be changed, as long as both spouses sign off on the modification. If something changes, such as your marital property or number of children, and you wish to update your prenup with the most recent information, you and your spouse must both agree to make the change.
The most common grounds to dissolve a prenuptial agreement include coercion or duress, unconscionability, and failure to disclose. The courts will generally enforce prenuptial agreements; however, when one or more of these grounds exist, the court may see fit to void all or parts of a prenup.
