In California, a person who rents a room in a house is known as a lodger. Lodgers have many of the same rights as regular tenants, and these rights are governed by the rental agreement that spells out key provisions such as the rental period, who is allowed to live in the room, and how much rent the lodger has to pay.
3-day Notice to Perform Covenants or Quit (Fix a problem or move out) A landlord can use this kind of Notice if their tenant isnt following the rental agreement or lease, and the problem can be fixed.
In order to evict a lodger, the landlord only needs to give the lodger a written notice that is as long in length as the period of time that the lodger pays rent for. For example, if the lodger pays rent on a weekly basis, then the landlord only needs to give 7 days written notice to the lodger.
If your landlord evicts you for one of these reasons, they must first give you one months rent or waive one months rent to help you move out. What notice does the landlord have to provide me?
After the Writ of Execution has been served to the tenants, they will be given a grace period of 5 days to vacate the property. The sheriff will execute the eviction and forcibly remove them if they remain in the property after the grace period given to them.
If the tenant does not pay the rent within 3 days of receiving the 3-day period, he or she must still move out in 30 days. If the tenant does not move out after the 30 days, then the landlord has to file an unlawful detainer case.
You can: pay the full amount of rent that is overdue, move out voluntarily, make a rent payment plan or moving plan in agreement with the landlord, temporarily stop the eviction by filing for bankruptcy, wait for the sheriffs deputy to show up to your doorstep, or try to fight the eviction in court.
