If one co-tenant is leaving in a periodic term, they can end their own tenancy under a periodic agreement by giving a 21- day termination notice to the landlord and each other co-tenant. Once they vacate the premises by the date in the notice, they are no longer a tenant under the agreement.
To request to have your name removed from a lease, you can lodge Form 2 Application for minor civil dispute residential tenancy dispute. The form lists the relevant sections of the Residential Tenancies and Rooming Accommodation Act 2008 that can be used to remove your name from a lease.
Fixed-term agreement If the landlord/agent wants to end your agreement at the end of the fixed term, they must give you at least 30 days notice that includes the last day of the term. If the landlord/agent applies for a termination order, the Tribunal must terminate the agreement.
Tenants sign a contract containing terms that bind them to certain obligations under the lease. The lease agreement is between the landlord and tenant only. Occupants are authorized to reside in the property with the landlords permission.
Dear [Landlords name], I wish to inform you that I will be terminating my lease on [date you plan to terminate]. I will move out my belongings and return my keys to [address of property management office] by [date you plan to terminate].
It only takes one party to sever a joint tenancy. One of the owners can unilaterally decide that they want to dissolve the joint tenancy by transferring their share of the property to themselves, or conversely selling their shares. This would break up the agreement set forth by a joint tenancy.
This change must be in writing and signed by both the landlord and tenant(s) and state what date it takes effect from. It can be written in the tenancy agreement or on a separate document that is then attached to the tenancy agreement. The landlord must give the tenant(s) a copy of this written variation.
Terminating a co-tenancy All must jointly give the landlord a 21-day termination notice in a periodic agreement, or a 14-day termination notice for the end of a fixed-term agreement (see Terminating without a reason above).
