Amending a Living Trust in California These amendments do not need to be docHubd to count, but they do need to be witnessed and signed, or at least created holographically (in the grantors handwriting, with the grantors signature).
In most cases, you need a courts approval to amend or revoke an irrevocable trust. The trustee must petition the court to make an appropriate change.
Generally, you change the name of a revocable trust through the formal amendment process. A trust can be amended to modify the substance of the trust (how it works, who it benefits, who serves as trustee) or it can be modified to change the formalities of the trust itself.
A trust may also be set up by a will, which leaves property in trust for a beneficiary. These trusts are called testamentary trusts and are usually irrevocable. Trusts are not filed or registered with the Court. You may wish to contact the County Recorder or the attorney who prepared the trust to obtain copies.
Revoking or amending a revocable living trust can be done with or without an attorney. You can amend a living trust without having to go to court. There are a few ways to do this. You can do it yourself, using living trust forms you find online, you can use an online service, or you can use an attorney.
Send notice in writing to all of the trust beneficiaries and any other interested parties providing them with the effective date of the trust dissolution. Obtain signed documents from the beneficiaries acknowledging their receipt of trust distributions.
You begin by removing all assets previously transferred into the trust. Then, obtain and fill out a complete revocation form. You will have to explain why you chose to revoke your trust (usually because of a change in circumstance, and so on). This document may also be known as a trust revocation declaration.
