Is there a fine for not having an EICR? Landlords who fail to conduct an EICR (and any work it recommends) before a new tenancy commences will face a fine of up to 30,000. Local authorities are responsible for enforcing these rules, as specified under the Housing Act 2004.
Can Tenants Refuse Access to a Property? If you turn up unannounced, for example without written notice, the tenant can refuse to grant entry. To avoid this, give plenty of warning.
If there are faults that need fixing, remedial works must be carried out within 28 days (or the timescale specified during the report). Ideally, the faults should be repaired as soon as possible. If the property is vacant, any C1 or C2 faults must be repaired before a tenant moves in.
What happens if I do not have an EICR? On the face of it, not having an EICR is unlikely to invalidate any Section 21 Notice and so you should still be able to evict your tenant under Section 21 without having an EICR.
As a landlord, you will be responsible for arranging a landlord electrical safety certificate for each property you own. From 1 April 2021, you will need a landlord electrical safety certificate (also known as an EICR certificate) for your property if you dont already have one.
You do not need to provide an Electrical Installation Condition Report (EICR) in order to sell a property, although it will give your buyer peace of mind that the property they are buying is electrically safe.
