[Music] should i include right of first refusal in my parenting plan hi im bill farias founder of farias family law this question came up about a week ago a lady is moving toward divorce and shes concerned that her soon-to-be ex is going to leave the children with other family members for extended periods of time so the way that this works is first of all right of first refusal is if parent a is going to be away for x amount of time paren a has an obligation to docHub out to parent b to notify that parent and to give that parent the opportunity to parent the children during that time before parent a docHubes out and puts in place another child care arrangement and so the best way to think about right of first refusal is this first of all you should avoid it whenever possible and what i mean by that is that if these absences are happening consistently and over an extended period of time that should be already factored into the parenting plan right in other words you shouldnt need write

At What Age Can My Child Refuse Visitation? Contrary to popular belief, there is no specific age at which a child can refuse to see a parent or comply with a custody order. In fact, Pennsylvania law defines a child as an unemancipated individual under 18 years of age.
You can seek a modification of a child custody and visitation order at any time if you can show the court that a docHub change of circumstances has happened since you entered the first order.
Each parent is entitled to know where the children are during visitations. They should also know if the children are left with other people such as babysitters or friends when the other parent is not there.
In order to modify child custody in California, a parent must request a court hearing unless the other parent voluntarily agrees to the change. Additionally, the parent seeking the change must complete Form FL 300.
A parent seeking to modify custody in Washington must file legal forms with the court, including a Petition for Modification of Adjustment of Child Custody Decree/Parenting Plan. The petition should specify what kinds of custody changes the parent is seeking.
How Do I Request Modification? Making a request only requires you to submit one form: Form FL-300, the Request For Order. Once filed with a court, the process will begin in earnest. You may also file Form FL-311, Child Custody, and Visitation, though this is optional.
Generally, you can only ask to have a final custody order modified if there has been a substantial change in circumstances since the order was issued and changing the order would be in the childs best interests (although the exact legal standard can vary from state to state).
parent has moved a docHub distant from non-custodial parent, parent has lost their job and cant provide financial support, child is now older and can have a say in custody preference.
