Are texts considered written notice? If you want texts to be legally binding between both parties, that agreement must be set up beforehand and must be in writing.
Civil Code Section 1946.2 implements just cause limitations. They prohibit termination without just cause of a tenant who has lived in the unit for at least 12 months. These just causes include both tenant at-fault behavior (such as repeated late rent) and no-fault reasons (like owner move-ins).
A landlord can use a 30 day-notice to end a month-to-month tenancy if the tenant has been renting for less than a year. A landlord should use a 60-day notice if the tenant has been renting for more than one year and the landlord wants the tenant to move out. (CCP Section 1946.1.)
In California, residential rental agreements automatically convert to month-to-month tenancies at the end of your lease term. At the end of each month thereafter, the agreement renews automatically for themselves in perpetuity as long as you, the tenant, remain in possession of your home.
Under California state law, a landlord can terminate a month-to-month tenancy by serving a 30-day written notice if the tenancy has lasted less than one year, or a 60-day notice if the tenancy has lasted more than one year.
A month-to-month tenancy may be terminated by either the landlord or the tenant simply by giving written notice from one side to the other. Unless the rental agreement or lease provides for a different time period, the notice to terminate must be given to the landlord at least 30 days before the tenant moves out.
Even if you dont have a lease, a California landlord cant kick you to a curb without warning. If the landlord wants you gone, hes required to give you at least 30 days notice on a month-to-month tenancy. There are exceptions, though -- circumstances in which the landlord can give you just three days to get out.
That is, the state definition of a landlord, a tenant, and a month-to-month lease will obligate either party in making sure that if and/or when terminating a month to month lease contract, the party wishing to terminate must give thirty days notice before the actual date of termination.
