What is module 4 of the SCCs?

In its May 2022 FAQs on the SCCs, the Commission states that Module 4 should be used where a processor in the EEA is hired by a controller outside the EEA, either to collect data in the EEA on behalf of the controller or to process data received from the controller in the EEA (question 30).

What is the docking clause in the EU SCC?

The docking clause is an optional clause, which provides a streamlined way to add new parties to a set of executed SCCs in the future, with the consent of all the pre-existing parties.

What do the new SCCs require?

The new SCCs also require both parties to conduct and document a Transfer Impact Assessment. This includes evaluating the circumstances of the data transfer as well as the third countrys laws and practices to ensure that they do not prevent the data importer from complying with the provisions of the SCCs.

Can you amend standard contractual clauses?

You may add or amend these clauses if you think they are appropriate. If you add any clauses, you must make sure that: they are only about business related issues only and do not alter the effect of the standard contractual clauses.

What is the new SCCs Clause 8?

The new SCCs also place docHub additional obligations on the data exporter and data importer. Firstly, clause 8 requires the data exporter to warrant that it has used reasonable efforts to determine that the data importer is able to satisfy the obligations of the SCCs.

Do you need a DPA with the new SCCs?

Do I need to update my DPA to account for new SCCs and when? Yes, but there is a grace period. If you have negotiated a separate DPA with Twilio that includes the prior EU-approved version of the SCCs, those SCCs will remain in place and effective until December 27, 2022.

What is the module 4 of the GDPR?
