AB 1949 provides eligible employees with up to five days of bereavement leave upon the death of a qualifying family member. The five days of bereavement leave provided under AB 1949 are separate and distinct from the 12 weeks of leave permitted under CFRA it is an additional form of protected leave.
AB 1949 amends the California Fair Employment and Housing Act (FEHA) to create a statutory right for eligible employees to take up to five days of bereavement leave upon the death of a covered family member. AB 1949 applies to all public agencies and all other employers with five or more employees.
As a general rule, most companies do not roll over the bereavement leave from one year to the next, unlike other types of time-off like PTO/ sick days.
Full-time employees shall receive up to three (3) days of bereavement leave with pay (up to a maximum of 24 work hours or 36 hours for 56 hour employees).
Generally, organizations offer three to five days of time off per loss of a loved one each year. Some companies may offer more for immediate relatives and fewer for extended relatives.
In case of multiple events of bereavement, most companies do let employees use the recommended time-off for each event.
Bereavement leave is time off granted to an employee in the event that a loved one passes away. The intention is to allow employees to grieve, attend funeral services or a memorial, or deal with financial and legal matters that may come up after death.
Theres no maximum amount of bereavement leave you can take in any one year, unlike sick leave and annual leave.
