If there is no express agreement between the landlord and tenant as to the term of the tenancy, Section 27-35-130 of the South Carolina Code of Laws, which follows, applies: All tenants at will and domestic servants shall vacate the premises occupied upon twenty days written notice.
Five-Day Notice to Pay Rent: Unless the lease contains the following statement, IF YOU DO NOT PAY YOUR RENT ON TIME. This is your notice. If you do not pay your rent within five days of the due date, the landlord can start to have you evicted.
In South Carolina, the grace period is 5 days. Some landlords designate the date when the lease is signed as the rent due date. For example, the rent for a tenant who signs a lease on October 10 will be due on the 10th of every successive month.
