The two-dismissal rule set forth in section 1387, subdivision (a) reads as follows: An order terminating an action pursuant to this chapter, or Section 859b, 861, 871, or 995, is a bar to any other prosecution for the same offense if it is a felony and the action has been previously terminated pursuant to this
(a) Notice of motion A party seeking dismissal of a case under Code of Civil Procedure sections 583.410-583.430 must serve and file a notice of motion at least 45 days before the date set for hearing of the motion. File your forms at the courthouse where you filed your case. The court clerk will process your Request for Dismissal (Form CIV-110) and Form CIV-120. The clerk will keep the original and return the copies of Form CIV-110 to you, stamped Filed. Keep one for your records.
