A business associate is a person or entity, other than a member of the workforce of a covered entity, who performs functions or activities on behalf of, or provides certain services to, a covered entity that involve access by the business associate to protected health information.
The Privacy Rule provides that a business associate agreement (BAA) must require a business associate to return or destroy all PHI at the termination of the BAA where feasible. 45 CFR 164.504(e)(2)(J).
Business Associate Agreements Under HIPAA a Covered Entity has been required to have a Business Associate contract or as it is commonly known, a Business Associate Agreement (BAA) with each of its BAs.
The HIPAA Privacy Rule requires all Covered Entities to have a signed Business Associate Agreement (BAA) with any Business Associate (BA) they hire that may come in contact with PHI. The HIPAA Omnibus Rule changed how BAs and Business Associate Subcontractors (BAS) can be held liable for potential HIPAA violations.
Acceptable methods used today include shredding, incineration pulping and pulverization. In addition to the records maintained for a specific retention period, there are other documents that should be destroyed after their usefulness has ended.
As a result of the Final Rule, business associates and subcontractors are required to enter into business associate agreements with each other. Subcontractors will be responsible for HIPAA compliance not only under those contracts but also directly under the HIPAA rules themselves.
