The ADA does not prohibit employers from discharging employees who report to work under the influence of alcohol or illegal drugs.
Click Log In and access the Clearinghouse using your login.gov username and password. If you have a new violation in your Clearinghouse record, your Driver Dashboard will display a message prompting you to select a SAP. Click designate your substance abuse professional to begin the process.
Driver violation records will be available in the Clearinghouse for five years from the date of the violation determination, or until the violation is resolved through the successful completion of the return-to-duty (RTD) process and follow-up testing plan, whichever is later.
SAPs will use the Clearinghouse to report specific information about a CDL drivers return-to-duty (RTD) activities. Very specifically, SAPs will report on the return to duty initial assessment and on the drivers eligibility for return to duty testing.
Step 4: Returning to Work Once your SAP provides you with your return-to-duty documents, you must bring them to your employer. Your employer then has the right to order a return-to-duty DOT drug or alcohol test. If the test comes back positive, you will receive a new violation that requires further SAP intervention.
