bereavement leave following the death of certain family members. Beginning January 1, 2023, private employers with five or more employees are required to grant an eligible employees request for up to five days of bereavement leave from work following the death of the employees family member.
Grief experts recommend 20 days of bereavement leave for close family members. 4 days is the average bereavement leave allotted for the death of a spouse or child. 3 days is the average time off given for the loss of a parent, grandparent, domestic partner, sibling, grandchild or foster child.
The death of an extended family member, like aunts, uncles, nieces, nephews, and cousins, can also qualify for bereavement leave. Some companies even allow their employees time off to grieve the loss of a pet.
4: BEREAVEMENT LEAVE. (a) Definition. Bereavement leave is paid leave which is available to an employee at the time of death or funeral of a member of the employees immediate family as defined below in section 4.2.
AB 1949 provides eligible employees with up to five days of bereavement leave upon the death of a qualifying family member. The five days of bereavement leave provided under AB 1949 are separate and distinct from the 12 weeks of leave permitted under CFRA it is an additional form of protected leave.
Are bereavement and funeral leave the same? Bereavement leave and funeral leave are similar but not the same. Some employers provide employees to take leave for the duration of the funeral only. They do not allow employees additional time to grieve the loss of the loved one.
Usually, bereavement leave allows leave time for a funeral or memorial service, any financial obligations that need to be settled (for example, inheritance or estate affairs), and personal mourning time. Some employers will be more flexible and allow for extra time if travel is required.
