Under the Ontario Construction Lien Act a lien must be registered at the Land Titles Office within 60 days from the date the work is completed or the materials supplied to the project job site.
Form 7 - Certificate of Completion of Subcontract Under Subsection 33 (1) of the Act Construction Lien Act.
To pursue a construction lien, an individual must preserve it by registering the lien against title to the property or providing a copy of the lien to the owner of the land (i.e. when the land is owned by the provincial or municipal government).
Residential projects Direct contractors must file their lien no later than the 15th day of the 3rd month after the month their contract was completed, terminated, or abandoned.
Placing preserving a construction lien The right to file a lien is time-limited. Any party with a right to place a lien must do so within 60 days after the date the governing construction contract is completed or abandoned.
The Construction Lien Act provides that a preserved or perfected lien and certificate of action may be deleted from title by the registration of a release of the lien by the lien claimant, by a court order discharging the lien and/or action or by a court order vacating the lien and/or action.
Consent Order/Court Order In exchange for the monies being held in court, the lien will then be removed. A Consent Order involves all parties (including the lienholder) agreeing to the monies being placed in Court in exchange for the removal of the lien. This is an amicable way to have the lien removed.
In Ontario, liens are only valid for 90 days from the date of last on site working. If your customer refuses to pay within the first 30-60 days, legal action or collections may be an additional action you want to take to help enforce your lien.
