Does a Land Contract Have to be Recorded in Michigan? A land contract is not legally required to be recorded in Michigan. However, both the buyer and the seller may wish to record the contract to protect their interests in the property.
Upon fulfilling the land contract, you should transfer the propertys title to the buyer. You must also provide a deed declaring that the property is free of liens or mortgages.
If there is a promise to hold the offer open but no specific time period is laid out, the offer cannot be revoked for a reasonable amount of time. However, whether the time period is specifically laid out or not, an offer cannot be held open for longer than three months.
Disadvantage #1: The title does not automatically pass to the purchaser in a land contract. Disadvantage #2: The seller could be held legally responsible for inspection issues with local or state authorities. Disadvantage #3: Forfeiture of a land contract by the purchaser is a fairly common occurrence.
If a judgment of possession is granted, the buyer has 90 days to redeem the property if less than 50% of the purchase price has been paid or 6 months to redeem if 50% or more of the purchase price has been paid. The redemption amount is the amount that is past due. MCL 600.5744(4).

In forfeiture, the seller cannot accelerate the debt. Therefore, the vendee can cure by paying the past-due monthly payments.
