A trademark can be a word, phrase, symbol or image unique enough to register as a business exclusive brand. By trademarking a logo, business owners acquire legal protection against counterfeits, copycats and fraud.
Why trademark a logo? Registering your mark gives you legal protection and lets the public know you own the mark. In fact, the mark can only be used after the logo is actually registered with the U.S. Patent and Trademark Office (USPTO).
What are Logo Usage Guidelines? A logo usage guideline is a document you write up for future reference that includes different versions of your logo design and how they are to be used. The logo you choose to tell your businesss story will also convey your brand message.
Higher value tends to lie in name recognition rather than familiarity of a logo. Since logos change more often than names, it usually makes more sense to register a standard character mark to protect the business moniker itself.
What is Trademark vs. Logo? A trademark protects a slogan, phrase, word, company name, logo, or design that identifies a company and/or its goods. A logo is a symbol or design used by a company that may fall under trademark protection laws.
A trademark is a distinguishable and recognizable sign, design, or expression that identifies specific products or services of a particular source as distinct from others. A logo is a graphic sign, mark, or symbol used to identify a particular source. It is fair to say that a logo is a type of trademark.
You can register a logo with the USPTO by using the Trademark Electronic Application System (TEAS) or other online trademark service. If your logo includes design elements, you will need to upload an image, using a . jpg file, of the logo as part of your trademark application.
Do not use the shield or wordmark alone. Both elements should always appear together. Never alter the wordmark or any visual elements, and do not change the font of the wordmark or accompanying names of colleges or divisions. Never overprint something on top of the logo, and do not use the logo as a background pattern.
