There are two types of will: notarial and holographic. Every will, regardless of type, must be in writing and executed in a language or dialect known to the testator.
Every will must be acknowledged before a notary public by the testator and the witnesses. The notary public shall not be required to retain a copy of the will, or file another with the office of the Clerk of Court. Art. 807.
There is no need for a will to be drawn up or witnessed by a solicitor. If you wish to make a will yourself, you can do so. However, you should only consider doing this if the will is going to be straightforward.
What makes a Will legal? In Queensland, a Will must be in writing, signed and dated in the presence of two witnesses over 18-years of age. Your witnesses cannot benefit from your Will or know someone who may benefit from your Will.
THE VALIDITY OF A WILL It must be made voluntarily. It must be in writing (either typed or hand written) It must be signed by the testator.
