The Uniform Premarital Agreement Act (UPAA) has applied to California prenups since 1986. In general, this law states that written prenuptial agreements signed by both parties, in contemplation of marriage will automatically become effective once the couple marries.

The Bottom Line. If you want a valid prenup in California, you must follow the 7-day rule. No ifs, ands, or buts about it. As the name suggests, the 7-day rule requires a full seven calendar days between the time the final prenup is presented to the other party and the time the parties sign the agreement.
The most common grounds to dissolve a prenuptial agreement include coercion or duress, unconscionability, and failure to disclose. The courts will generally enforce prenuptial agreements; however, when one or more of these grounds exist, the court may see fit to void all or parts of a prenup.
To be valid, there are two requirements under California law: It must be signed voluntarily by the parties. Before signing, each party must be provided with a fair, reasonable, and full disclosure of the property or financial obligations of the other party. In the U.S., courts have discretion to recognize foreign prenuptial agreements and will generally do so unless the agreement is found to be unconscionable or one that otherwise frustrates public policy.
Remember, California law requires a waiting period (minimum should be 7 days from FINAL draft). So, an optimal time to get a prenup would be about 3 months before your wedding.
