[Music] alright guys in todays video were gonna talk about three benefits of land contracts I have my business partner Brent Fisher here and we have a real estate portfolio of nine units we have two properties theyre both multi-family and our first one we got was off of the land contract and land contracts highly recommend them a lot of business their property owners dont do them because they want their cash but if you find someone in the position that owns a property free and clear and they want to be the bank so essentially theres a person who owns a piece of property and instead of them selling it through a bank through traditional financing they act as the bank right so they have this piece of property so lets say for example I own a piece of real estate Brent says he wants to buy that piece of real estate he could approach me and say hey Chris would you be willing to sell this property to me off the land contract now what that means is were gonna negotiate terms of the sale

Extinguishment of the covenant is the only other option. There are three ways to extinguish a covenant; (1) an agreement between the interested parties to the covenants; (2) a merger of ownership or (3) a final decision by a court of law. All three paths are challenging.
If the restrictive covenant meets certain criteria, you can apply to the Upper Tribunal to have it removed. Alternatively, if all parties who benefit from the restrictive covenant agree, a Deed of Release can be used to remove it.
By contrast, a covenant does NOT run with the land if it is personal or tied to any individual owner. Promises purely for the benefit of one having no interest in the land will not be enforced against successive owners of real property as a covenant running with the land.
You can use a contract amendment letter to list the changes to the original document and have both parties sign. You can create a contract amendment created from a template or from a legal services provider. You can add amendment pagesdigital or printto the end of the original signed contract.
The Upper Tribunal can discharge or modify the restrictive covenants if: The restriction is deemed obsolete as a result of changes in the character of the property or the neighbourhood or other circumstances (LPA s. 84(1)(a)).
How do I remove a restrictive covenant from my property? If the restrictive covenant meets certain criteria, you can apply to the Upper Tribunal to have it removed. Alternatively, if all parties who benefit from the restrictive covenant agree, a Deed of Release can be used to remove it.
Chapter 211 allows the property owners to adopt a new method to amend their deed restrictions. The chapter does not outline the procedure. This is left to the discretion of the property owners association.
Restrictive covenants can be removed or varied in the following ways: Application to the land registry. If we discover that the restrictive covenant is no longer enforceable then we can make an application to the land registry to remove the restrictive covenant. Negotiation and Deed of Release. The Lands Tribunal.
