To end a month-to-month lease, the tenant must serve their landlord a 30 days notice. (Tenn. Code Ann. 66-28-512(b)).
For month-to-month tenancies, the landlord or tenant must deliver a notice at least fifteen (15) days before the next time the rent is due informing the other party that the lease will be terminated. Any time period shorter is ineffective.
California landlord-tenant law only allows landlords to raise the rent at the end of the lease period, and limits increases to twice per year for month-to-month and other short-term leases. In most instances, landlords will only have the ability to raise the rent once every year if the lease period is that long.
A month-to-month tenancy may be terminated by either the landlord or the tenant simply by giving written notice from one side to the other. Unless the rental agreement or lease provides for a different time period, the notice to terminate must be given to the landlord at least 30 days before the tenant moves out.
Excluded tenancies or licences Your landlord only needs to give reasonable notice to quit. Usually this means the length of the rental payment period so if you pay rent monthly, youll get one months notice. The notice does not have to be in writing.
A landlord cant force you to move out before the lease ends, unless you fail to pay the rent or violate another docHub term, such as repeatedly throwing large and noisy parties. In these cases, landlords in Massachusetts must follow specific procedures to end the tenancy.
Under California state law, a landlord can terminate a month-to-month tenancy by serving a 30-day written notice if the tenancy has lasted less than one year, or a 60-day notice if the tenancy has lasted more than one year.
Unless the rental agreement provides a shorter notice period, a California tenant must give their landlord 30 days notice to end a month-to-month tenancy. Tenants should check their rental agreement to see if it requires giving notice on the first of the month or on another specific date.
If the tenant doesnt move out and doesnt pay the rent, the landlord can start an eviction proceeding by filing a summons and complaint in a court in the county where the rental property is located. Also, a tenant who refuses to leave may have to pay double the rent for the time the tenant stays in the rental.
Tenants must provide notice of their intent to vacate the premises in an amount of time equal to the number of days between rent payments. So, whether the lease is a lease with a fixed end date or is a month-to-month lease, if a tenant pays rent every 30 days then they are required to provide 30 days written notice.
