The incontestable status provides a presumption that the mark has acquired secondary meaning. However, incontestable trademarks can still be cancelled if the mark is generic. In addition, abandonment (or non-use) of a mark provides grounds to cancel an incontestable trademark.
Q: What Invalidates a Trademark? A: The USPTO may invalidate a trademark if they determine it is too closely resembling another one and could cause confusion in customers. Trademarks must be distinct and create a different impression in customers than others.
Likelihood of confusion is a common reason for refusal of a trademark application. The USPTO will review your application and compare your mark to any existing trademark applications or registered trademarks.
If your trademark has not published in the Trademark Official Gazette, use the TEAS Voluntary Amendment form. If your trademark has published but hasnt registered, use the TEAS Post-Publication Amendment form. If your trademark has registered, use the TEAS Section 7 Request form.
If your mark is registered in color, you will not be able to change colors when using the mark to sell your goods or services. In other words, a registered trademark in color requires that you use the exact same design mark with the same colors to maintain your registration.
Other grounds for challenging a registration will be available even if the trademark acquires incontestability status. Some of these grounds include: (1) fraud; (2) abandonment; (3) false suggestion of a connection; (5) functionality; (6) genericness etc.
Trademark infringement is defined as the unauthorized use of a trademark or service mark. This use can be in connection with goods or services and may lead to confusion, deception, or a misunderstanding about the actual company a product or service came from.
However, the Trademark Manual of Examining Procedure (TMEP) 1202.05 also statutorily allows for protection of a companys colors. Brand colors can be registered on the Principal Register if the mark meets an acquired distinctiveness standard (under 2(f) of the Trademark Act (15 U.S.C. 1052(f))).
