hi everyone welcome to another episode of the ask amity show um as always this is jennifer and im here with cindy um so today wed like to talk about a submission that we had from our client um you know with a question as to you know which one would control if you have a tod deed which is the transfer on death deed and a living trust um which one would be the binding document so in general um the one that would take precedence would be the last recorded document so whatever is the most recent before death generally that would be the one that would be controlling um and one thing to also keep in mind is you know for a transfer on death deed there are certain limitations and restrictions that you really need to um just understand fully before you take that route so again a transfer on death deed is when you add a beneficiary on your title of the property to name that beneficiary as the one whos going to inherit your property upon your passing so the tod deed is only applicable to cert

There are circumstances where the owners of a property may not or cannot be recorded on the title records. Because a deed of trust is not legally required to be registered anywhere (although it is possible to register it at the Land Registry), the underlying financing of the purchase can be kept private.
It is now a requirement that certain trusts are registered, so that HMRC have a record of the beneficial ownership. Although it has taken a number of years to bring about, the deadline for registering such trusts is 1st September 2022.
Do you need a Solicitor? We strongly advise that you use a Solicitor to prepare your Declaration of Trust. Whilst you may be tempted to create your own, or use a Do it Yourself Declaration of Trust template, you risk serious legal implications of not having your wishes correctly reflected.
For taxable trusts created on or after 6 April 2021, the trustees have had to register the trust within 90 days of becoming liable for tax or 1 September 2022 whichever is later. Different registration deadlines applied for taxable trusts created before 6 April 2021.
