Non-competition agreements must generally be supported by valid consideration, meaning the employee must receive something of value in exchange for the promise to refrain from competition.
Non-compete agreements are legally enforceable in Florida. They are deemed valid restraints on trade as long as all legal requirements are met. That being said, Florida law does look at non-compete contracts with some general skepticism.
A contract that is sloppy, lacking detail, hand written, not thought out, and clearly not approved by a lawyer, is a huge red flag. It is important you make sure this document states how the contractor will protect you, your home, and the work being done.
Typically, the only way to fight a non-compete agreement is to go to court. If you are an employee (or former employee) who signed such an agreement, this means you must violate the agreement and wait to be sued. It may be that your former employer has never sued another employee to enforce the non-compete agreement.
However, some states, like California, do not recognize noncompetes. Other states won't enforce them if they're seen as too broad — in other words, they're not limited enough in length of time or geographic scope and they make it unreasonably difficult for a worker to find other employment.
Many Non-Competes are unenforceable because they restrict competition across too broad of a territory. Non-Competes usually describe a restricted area in which the employee cannot compete.
Generally, courts find that an agreement is reasonable if the geographical restriction coincides with the area where the employee previously worked. The employee cannot work for a competitor in that same area.
If you are an employee who has been given a non-compete clause with your Employment Agreement, it may no longer be enforceable. Employers are no longer permitted to issue non-compete agreements to their employees in Ontario.
Your contract might restrict what work you can do next, but your employer can only do this if it's needed to protect their business. If there's nothing in your contract you can take any job you like.
You Can Void a Non-Compete by Proving How Severely Its Terms Would Affect You. The inability to make a living could be an “undue hardship” that renders a non-compete unenforceable. Think about your job skills and the specific terms of the non-compete agreement you signed.
