A: It depends on the terms of the severance package. Some employers might let you keep anything youve been paid under the severance plan if you are rehired at a later date. Some employers might make you repay all or part of any money you received if youre rehired within a certain amount of time.
Beginning January 1, 2020, agreements to settle employment disputes may no longer contain no rehire provisions, as California passes additional legislation spurred on by the #MeToo movement. California joins Vermont and Oregon as the first states to prohibit no rehire provisions in employment settlement agreements.
No-rehire clauses protect legitimate employer interests in mitigating future litigation risks when paying settlement sums to employees who have filed claims against the employer. Nevertheless, the California legislature enacted new law prohibiting these provisions.
New California Law Prohibits No Rehire Provisions in Settlements. California employers had until the end of 2019 to revise their settlement agreements to comply with newly passed legislation.
As of January 1, 2020, it is no longer legal for CA employers to include these clauses or provisions in employment dispute-related settlement agreements. Why include this clause in the first place? The purpose of including these types of clauses was to protect the employer from future allegations of discrimination.
In employment law, non-disparagement clauses are often found in employment contracts to prohibit current and former employees from making disparaging statements against their employer.
As to whether the non-disparagement clause is lawful, that depends on whether certain exceptions are provided for. There should be exceptions that allow a party to provide truthful testimony in legal proceedings, communicate truthfully with any government agency, or enforce the agreement the parties signed.
