Typical severance packages offer one to two weeks of paid salary for every year worked. You usually have a few weeks to accept a severance agreement, and once its signed, you may have a few days to change your mind.
There is no legal requirement under California law that employers provide severance pay to an employee upon termination of employment. Employees should refer to their employers policy with respect to severance pay.
Legal Considerations The Older Workers Benefit Protection Act (OWBPA), which is an amendment to the ADEA, specifies that employees have 21 days to consider a severance agreement and 7 days to revoke it after signing.
As to whether the non-disparagement clause is lawful, that depends on whether certain exceptions are provided for. There should be exceptions that allow a party to provide truthful testimony in legal proceedings, communicate truthfully with any government agency, or enforce the agreement the parties signed.

The OWBPA requires employers to provide a reasonable period for employees to review and consider the severance agreement. OWBPA-eligible employees have at least 21 days to determine whether to accept a deal in addition to a seven-day window to revoke their acceptance even after signing.
Some states have their own consideration and revocation periods as well. For example, in California, regardless of age, effective January 1, 2022, employees are entitled to a consideration period of 5 business days and must be informed of the right to consult an attorney for most severance agreements.
