The TMA allows a person to file a petition with the USPTO to request that the Director institute a proceeding to expunge (remove) or reexamine a trademark registration for a trademark that either has never been used in commerce or was not used in commerce before a particular relevant date.
A petition for cancellation of a trademark registration may be filed at any time. However, a mark which has been registered for more than five years may only be cancelled on the grounds enumerated in Trademark Act 14.
Non-use Cancellation Once registered, a trademark must be used in trade in a genuinely honest manner in relation to the goods and services for which it has been registered. Failure to use the trademark can result in its cancellation and abandonment.
You can request to change some information in your trademark application after your examining attorney approves your trademark for publication and before your trademark is registered. However, not all changes are allowed.
A cancellation is the removal of a trademark registration from the register in response to the filing of a cancellation action. The proceedings are initiated when a party with standing files a cancellation action with a designated administrative body within the trademark office or with the responsible court.
