Payers may use either box 2 on Form 1099-NEC or box 7 on Form 1099-MISC to report any sales totaling $5,000 or more of consumer products for resale, on a buy-sell, a deposit-commission, or any other basis.
As of 2020, box 7 is used to indicate the payer made direct sales of $5,000 or more of consumer products to a buyer. These products are generally direct sales of a product intended to be resold.
A late or missing 1099 can be stressful especially if youre waiting on the form so you can sit down and file your self-employment taxes. The good news is, you technically dont need these forms to file. And as long as you report all your income, not having a 1099-NEC wont cause you any trouble.
These companies will now have to mark the checkbox on box 7 with an X -- the part written: payer made direct sales. Theyll also need to provide a Form 1099-NEC to their sellers. Note that the due date for 1099-NEC is Feb. 1 to both the IRS and recipients.
The 1099-NEC is straightforward: Box 1 is for non-employee compensation and Box 4 is for federal withholding for that contract employee. To put it simply, income that the company used to report in 1099-MISC Box 7 will now be reported in 1099-NEC Box 1.
As of 2020, the 1099-NEC form is for all independent contractor income. The 1099-MISC is still a valid form. However, it is reserved for payments that fall outside of contractor or freelancer wages, such as rent or attorneys fees. The only business use for a 1099-NEC is for reporting nonemployee compensation.
Here are some examples of payments you need to report on the 1099-NEC: Professional service fees to architects, designers, accountants, software engineers, attorneys, and law firms. Fees paid by one professional to another (such as attorneys fees of $600 or more)
Box 7 is the distribution code that identifies the type of distribution received. The following are the codes and their definitions: 1 - Early distribution, no known exception (in most cases under age 59 1/2) 2 - Early distribution, exception applies (under age 59 1/2) 3 - Disability.
