ORAL AGREEMENT A landlord can evict the tenant or raise rent with only one months notice. Likewise, the tenant can give notice to vacate on one months notice. (One months notice means a full calendar month, and must include a full rental period.
Once a judge orders you to move, after a hearing or if you fail to show in court, you will have 10 days to move from your rental property. If you fail to do so, the court will order the sheriff in your county to evict you from the rental property.
A Missouri landlord can evict a tenant for a few legal reasons. These include going against the rental agreement/lease, nonpayment of rent, and excessive property damage.
Generally, an eviction report will remain part of your rental history for seven years. If you are in the process of applying for a lease, ask the landlord or leasing company to tell you the name of the tenant screening company they use.
In order for a landlord to lawfully evict a tenant, the landlord must file an eviction lawsuit with the court and then receive a court order allowing the eviction to occur. Before filing an eviction lawsuit, the landlord must give the tenant a notice. The type of notice required depends on the reason for the eviction.
Your landlord may still give you a lease termination or notice to vacate for reasons other than nonpayment of rent. If this happens, your landlord must go through the court process to enforce the eviction. Such a court process cannot happen before May 15. AND your landlord cannot legally force you out.
For example, a landlord is required to give a tenant a fifteen-day notice if trying to evict the tenant for violating the lease. If the tenant does not fix the violation within fifteen days, the landlord is then required to give the tenant a three-day notice to quit.
