What Factors do North Carolina Courts Consider When Calculating Child Support? The gross monthly income of each parent. The monthly cost of daycare for each child. The cost of medical insurance, like family group health insurance. The living arrangements of each child (overnights with each parent)
Common substantial changes in circumstances may include: a loss or gain of employment, a sudden change in either partys finances, a relocation of the parties or children, a death, a change in the childs wishes, etc.
In North Carolina, the only way to legally alter a child support order is to petition the court for a modification of child support.
A change in circumstances at least 3 years after the last support order or review will warrant modification when at least a 15% difference (upwards or downwards) exists between the amount of the current obligation and the amount the party would owe if the obligation were calculated using their current income.
You must file a Family Law Financial Affidavit, Florida Family Law Rules of Procedure Form 12.902(b) or (c), and the other parent will be required to do the same.
States may vary on specific circumstances, but these are some of the more common situations that lead to child support modifications being granted: A change in the childs needs. A childs medical emergency. The paying parents temporary inability to pay due to a medical emergency or loss of job.
CSS automatically reviews child support orders every three years if the family is receiving public assistance. Other orders being enforced through CSS office can be reviewed every three years, if either parent requests a review. A review can be requested at any time if a substantial change in circumstances occurs.
If your existing order is at least three years old, and if an application of the Guidelines to your current situation would change your child support by 15% or more, this is considered an automatic substantial change of circumstances.
Under what is known as common law, a new child has no effect on a support order. The prevailing thought was that a parents first children had priority. But that reasoning is becoming pass. The current thinking in many states, Virginia included, is that all a parents children should have their needs addressed.
The circumstances of one or both parents have changed If a parent suffers from a health problem, loses their job, has been jailed, or they are no longer able to provide a suitable living environment for the child, a judge might find that there are circumstances warranting a custody modification.
