The maximum adoption credit taxpayers can claim on their 2021 tax return is $14,440 per eligible child. Taxpayers should complete Form 8839, Qualified Adoption Expenses. They use this form to figure how much credit they can claim on their tax return. An eligible child must be younger than 18.
For adoptions finalized in 2022, there is a federal adoption tax credit of up to $14,890 per child. The 2022 adoption tax credit is NOT refundable, which means taxpayers can only use the credit if they have federal income tax liability (see below).
Qualified adoption expenses paid before the year the adoption becomes final are allowable as a credit for the tax year following the year of payment (even if the adoption is never finalized and even if an eligible child was never identified).
You can claim an adopted child if the adoption has been legally finalized. Adopted and foster children are treated the same as biological dependents for tax purposes.
For private domestic adoptions, expenses incurred in 2020 for a non-finalized adoption can be claimed with 2021 taxes. Expenses from 2021 cannot be claimed until 2022 taxes are filed. If the adoption finalizes in 2022, parents can claim 2021 and 2022 expenses with their 2022 taxes filed early next year.
Neither you nor the IRS can stop someone from filing a tax return with your child as a dependent.
For adoptions finalized in 2023 (tax returns claimed in 2024), the maximum amount a family can receive as credit is $15,950 per adopted child. For adoptions finalized in 2022 (tax returns claimed in 2023), the maximum amount a family can receive as credit is $14,890 per adopted child.
The credit is nonrefundable, which means its limited to your tax liability for the year. However, any credit in excess of your tax liability may be carried forward for up to five years. The maximum amount (dollar limit) for 2022 is $14,890 per child.
